Terms and Conditions for Lory's Workout Hub

Scope of Application

1.1. All offers, services, provisions, and/or deliveries (hereinafter referred to as "services") provided by Lory's Workout Hub (hereinafter "LWH") in connection with the offering, booking, and delivery of courses on the website "https://www.lorysworkouthub.at" are exclusively governed by these Terms and Conditions (hereinafter "T&Cs") in their latest version. By using or accepting the services, the customer (hereinafter "customer" or "consumer") agrees to these T&Cs. Deviations from these T&Cs require explicit prior written consent from LWH.

Contract Conclusion and Validity

2.1. A contract between LWH and the customer is concluded when the customer completes the order process on the website. By clicking the "Order with Obligation to Pay" button, the customer submits a binding offer. The contract is formed upon acceptance of the offer via email. An automatically generated email confirming receipt of the offer does not constitute acceptance. The customer is solely responsible for providing accurate and complete information and maintaining a functional email address.

2.2. Consumers have the right to withdraw from online contracts within fourteen days without providing reasons. To exercise the right of withdrawal, the consumer must inform LWH at lorenafitsyou@gmail.com with a clear declaration (e.g., by email or mail) of the decision to withdraw. It is sufficient to send the withdrawal notice before the deadline. The attached sample withdrawal form may be used.

2.3. Upon withdrawal, LWH will refund all payments received within 14 days of receiving the withdrawal notice, using the same payment method unless otherwise agreed. No fees will be charged for this refund.

2.4. Expiry dates for courses or services are indicated in their descriptions on the website. While future prices may change, LWH will honor previously purchased services until their expiry dates.

2.5. Promotional offers and discount codes are valid for one-time use per person unless explicitly stated otherwise. LWH reserves the right to charge the full price if a customer uses the same offer or code more than once.

Booking and Cancellation of Courses

3.1. Customers must purchase a class or service on the website before making a reservation.

3.2. Bookings for specific classes are considered leisure services provided at a specific time or within a designated period, exempting them from statutory withdrawal rights under applicable laws.

3.3. Cancellations are allowed up to 12 hours before a class or service. The class will be credited back to the customer’s account for future use within 14 days, subject to the service’s expiration date. Alternatively, an alternative booking can be made at the time of cancellation. Refunds are not issued in either case.

Studio Use

4.1. Customers must avoid unnecessary noise, disturbances, or endangering others.

4.2. Photos and video recordings of services, including course sessions, are only allowed with prior written consent from LWH.

4.3. LWH staff may issue behavior guidelines to prevent hazards, damages, or health risks. Customers not complying with these guidelines may be temporarily banned from using services.

Confirmation of Physical Fitness

5.1. Participation in LWH courses requires physical fitness. By enrolling, the customer confirms they are in good health, over 16 years old, and not knowingly pregnant or suffering from conditions that may pose risks during physical activity.

5.2. LWH is not obligated to verify the physical or psychological fitness of customers. Customers are responsible for adjusting their training to their capabilities and seeking medical advice if needed.

Final Provisions

6.1. Customers must provide accurate personal information when entering into a contract.

6.2. LWH is not liable for the accuracy or currency of website information or external links to third-party websites.

6.3. Austrian law applies, excluding conflict-of-law provisions and the UN Convention on Contracts for the International Sale of Goods. Contract language is English.

6.4. Notifications required under these T&Cs may be sent via email unless otherwise specified.

6.5. Customers agree to the processing of their personal data by LWH to the extent necessary for fulfilling contractual obligations or legal requirements.

6.6. If any provision of these T&Cs is deemed invalid, the remaining provisions remain unaffected.
